What is Worker's Compensation?



For centuries, cities and states in United States have been working to provide the workers the right for compensation if they have suffered from a workplace injury. States wants to ensure that they are able to protect the right of the workers and see it as a need to enforce this right to proper compensation.

Indemnification for Damages



When you sustain injury from your workplace you have the right for your compensation -- as long as it is not due to your own negligence. Let us first define injury. In legal context, injury refers to the wrong action or damage done to another. Since you have sustained an injury which is not due to your own negligence or fault you have the right to demand compensation.

“To indemnify for damages” refers to different things. I'll give you the most common damages that can be possibly covered by the workers compensation.

First there are medical expenses. The employer is liable to pay for your medical bills for any injury you've sustained during your work. This includes medical expenses such as physical examination, admission to the hospital, medical tests and medications necessary to treat the physical injury you've sustained. Medical expenses do not only cover those mentioned, it may also cover the therapy you need even for months until you've full recovered.

Second, there is what is referred to as moral damages. These refer to the mental anguish and pain you've suffered because of the workplace injury. Especially, if you are a family representing your lost loved ones - those who died while working or rendering service, no money can try to replace the mental anguish and pain you've suffered. However, there are certain cases where moral damages are granted.

Generally speaking, these are the two things are that workers need to indemnify for the injuries they've suffered. However, there are also instances where you can compel to pay your employer your salary. I'm not referring to your current salary, I'm referring to the salary or wages that you could have possibly earned if you were not injured. This is the third part of compensation you can ask for. Depending upon how badly you were injured, you may have been out of work for days, weeks or even months.
