Worker's Comp Settlements

How much will I get for a worker's compensation benefits settlement?

Settlement is purely voluntary. It becomes a settlement because both party herein referred to as the employer and injured party agreed to its content. Before agreeing to a settlement, you must know what you are entitled to and your rights. This will ensure that your employer is not trying to trick you and you get what is just. If you are really in doubt of the contents of your settlement, consult a workers compensation lawyer immediately.

What are you entitled to?

Permanent impairment -- If your injury makes you partially disabled to work or some type of permanent impairment but you are not fully disabled then you are entitled to a monetary award to compensate for your loss. The problem with this type of situation during the settlement is how do you compute the monetary award you are entitled to? How can you come up with an agreement with your employer? In the first place, how can you know an estimate of the monetary award which is favorable to you? For example, you lose your left hand due to work, how much monetary award you are entitled to? This is very hard to decide, even the employer offers you a certain amount you are not sure if that is a just compensation for what you had loss.

Before you agree to any our of court settlement, it is strongly advisable that you consult workers compensation lawyer. They have experience in this area and can make sure that you are getting the compensation that you deserve.

Medical expenses -- Your employer must pay for every medical expense that occurs related to your injury. This includes therapy, medications or other related expenses to heal the injury you've sustained. Instead of paying for all of this, your employer might offer you a lump sum settlement and in exchange he is doesn't have to pay for your medical expenses. The question is - “Is it worth it?” Unless your injury is minor, and you will be able to return in a short time period, you should contact a lawyer who is experienced with workers compensation claims. Because of their experience, they have a good understanding of what the typical medical expenses will be for the long term.

Time Loss Compensation -- If due to the injury, you are unable to work for a reasonable time, then your employer is obligated to pay for the wages you could have earned during this time period. However, during settlement the employer most likely try not to raise this issue, especially if the worker is not familiar with his rights. He can also offer a lump sum instead of trying to pay for your wages. If you are unsure of how long you will be out of work, you need to make sure that this settlement is in your benefit.

Think Before You Agree to a Lump Sum Settlement

Remember, when an employer is agreeing to a lump sum settlement, it may or may not be with your best interests in mind. In some cases they have been advised by their attorneys to offer you “fast money” because they either don't want the workers compensation claim on the record, they are aware that the injury was due to negligence or they see that the long-term expenses that will result of a workers compensation claim would far outweigh the amount that they are offering in the settlement.

Before you take the money, ask yourself -“Is it worth it after the pain I've gone through?” “Will this be enough to cover all of my expenses and my salary while I am out of work?”

If you are not 100% sure, you need to contact a workman's comp lawyer. Best Workers' Comp Lawyers can help you find one.
